Sandton Aesthetic Institute CC (registration number CK2009/203148/23) (Sandton Aesthetic) is a close corporation which sells skin and beauty products online.

NOTE: Please read these terms carefully.  Certain of them (indicated in bold) limit our liability or place liability on you.  If you have any queries, please contact nicky@sandtonaesthetics.co.za  

1              Acceptance of Terms

1.1          These Terms of use (Terms) are a binding agreement between you, the user, and us, Sandton Aesthetic.  By using or ordering any products through  this website, www.sandtonaesthetics.co.za (Website) you agree to these Terms.  If you do not agree to these Terms, do not use the Website or place any orders.

1.2          We may unilaterally change these Terms from time to time.  When changes are made, the amended Terms will be available on the Website.  It is your responsibility to familiarise yourself with these Terms and check them regularly for any updates.

2              Log-in details and passwords

2.1          You must be registered to place orders through the Website.  You are responsible for all actions taken using your user name, email address and password.

2.2          You agree that you will use your username and password for personal use only and not disclose it to any third party.

2.3          You will be liable for payment in respect of any orders made using your username and password, irrespective of whether the use of your username and password is unauthorised or fraudulent, except where the order is cancelled in accordance with these Terms.

3              Orders and payment

3.1          Orders may be placed and paid for using the payment portal on the Website.  Note that the product images do not reflect the actual size of the products.

3.2          All product prices are specified and all transactions will be processed in South African Rands (ZAR).  Your total order price will include the price of the product plus any applicable sales tax.

3.3          We reserve the right to change the prices specified on the Website at any time, without prior notice.  If we reduce the price on any shipped products within 7 working days of shipment, you may request a refund of the difference between the price you were charged and the reduced selling price.  To receive the refund you must contact us within 10 days of shipment.

3.4          We use a third party payment portal, Pay Fast Secure Payment Gateway, for online payments.  Use of the portal is subject to their terms, available at https://www.payfast.co.za/end-user-agreement.We do not have any control over the payment portal or access any information about your means of payment.  See clause 11 for details on the information we do collect.  We are not liable for any loss or damage resulting from a failure or refusal by the third party processor to process your payment.

3.6          We will not process an order until we receive an order confirmation from you and full payment.

3.7          You may not order products for on selling to a third party.  We reserve the right to cancel any order if we reasonably believe that any products have not been ordered for personal use.

3.8          Records of your orders can be accessed by logging on to the Website.

4              Vouchers

We do not offer online vouchers at this stage.

5              Product deliveries

5.1          We currently only deliver within South Africa.  Delivery is free for orders in excess of R750 and a flat courier fee of R190 applies to orders below R750.

5.2          We use a third party courier to deliver your products.  We may choose to use an alternative courier at any time.

5.3          Subject to stock availability, acceptance of your order by us and receipt of payment, your order will be processed and delivered as soon as possible, but no later than 30 days from receipt of payment.  You will be asked to specify the delivery address when ordering.

5.4          Delivery within a metropolitan area will typically take place within 3 working days.  Delivery to a regional or remote area will typically take 3 to 6 working days.

5.5          Delivery to very remote areas, not serviced by the courier, will be made to the nearest Post Office or to the nearest town accessible to you within the courier’s routes.  In this case we will contact you to make alternative delivery arrangements.

5.6          We do not deliver to farms, military bases, major chain stores, power stations, game reserves, lodges, airports or harbours.  In this case we will deliver the product to your nearest Post Office and contact you to let you know.

5.7          We will notify you if we are unable to deliver the product within 30 days from receipt of payment.  Within 7 days of this notice, you may cancel the order for the products.  If you cancel the order, we will reimburse you the purchase price.  To cancel an order, contact nicky@sandtonaesthetics.co.za

5.8          Our obligation to deliver a product to you is fulfilled when we deliver the product to the physical address provided by you for delivery.  We are not liable for any loss or unauthorised use of the product after it has been delivered to the physical address provided by you.

6              Product disclaimers

6.1          Certain skin products are only to be prescribed by a doctor.  If you have, or the person who will be using the product has, severe acne or eczema, skin allergies, are pregnant or breastfeeding or using any medications, please contact Nicky at nicky@sandtonaesthetics.co.za before ordering and we will advise you on the correct product.  Please answer all questions honestly and accurately, as this affects our ability to provide you with accurate advice.

6.2          If you are still unsure about which products to purchase, please contact us at nicky@sandtonaesthetics.co.za  and we will do our best to assist you.

6.3          Before using any product, please follow all instructions and recommendations on the packaging and package inserts.

6.4          We are not liable for any loss, damage or other liability (including death and personal injury) arising from:

(1)           ordering products without completing an online skin assessment in the circumstances referred to in clause 7.1;

(2)           providing inaccurate information or answers during the online skin assessment or when seeking assistance from us; or

(3)           purchasing or use (by you or a third party) of any products other than in accordance with the instructions or recommendations given in an online skin assessment, on the packaging and package inserts or during engagement with us.  

7              Returns policy

7.1          Unwanted products

(1)           You can return an unwanted product if:

(a)           it is unopened, undamaged and unused;

(b)           it is in its original packaging;

(c)           it is not missing any accessories; and

(d)           you contact us at nicky@sandtonaesthetics.co.za within 7 days of delivery of the products to you.

(e)           No returns of unwanted products will be accepted after 7 days,

7.2          If you return an unwanted product, we will refund you the full purchase price or, if you prefer issue you with a credit note which you can use to buy other products on the Website.  Your refund or credit note will be provided within 30 days of our receipt of the returned products. You will be responsible for the transportation costs for returning purchased products.

7.3          Defective or faulty products

(1)           If you receive a defective or faulty product, please inform us as soon as is reasonably possible, within 1 week of delivery.  No returns of defective products will be considered after 1 week.

(2)           You must contact us at nicky@sandtonaesthetics.co.za and we will collect the defective product from you at no charge.

(3)           After inspection of the defective product and validation of the claim, we will at your election either:

(a)           replace or exchange the product; or

(b)           refund you the full purchase price.

7.4          For all returns, we recommend that you use a carrier that offers a tracking facility.  If you do not do so and the goods are lost then no return or refund will be considered.

7.5          When returning a product you must ensure that:

(1)           the product is packaged safely for protection during transportation;

(2)           your reference number is clearly marked on the outside of the parcel; and

(3)           all accessories that accompanied the product are included.

8              Website disclaimers

8.1          We do not warrant the availability of this Website at all times, including in cases where there is a connection interruption or the Website is undergoing maintenance or upgrades.

8.2          We do not warrant that the Website is free from errors and viruses or any other malware that has the ability to corrupt your computer or mobile device.  You are responsible for ensuring that your devices have appropriate anti-virus protection.

8.3          Information provided by other users or third parties on the Website may contain links to third party websites that are not owned or controlled by us.  We are not liable for any loss, damage or other liability arising from your use of any third party websites or for the content, privacy policies, or practices of any third party websites.

8.4          We will take appropriate and reasonable technical and organisational measures to protect information shared over the Website.  We cannot however guarantee the security of transmitting information online to us and you accept the risk of providing information through the Website.

9              Cookies

9.1          When you visit our Website we may make use of “cookies” to automatically collect information and data about users.

9.2          “Cookies” are small text files used by websites or other platforms to recognise repeat users, facilitate the user’s on-going access to and use of a website or other platforms and allow the website or other platform to track usage behaviour and compile aggregate data that will allow the website or platform operator to improve the functionality of the website or platform and its content.

9.3          The type of information collected by cookies is not used to personally identify you.

9.4          If you do not want information collected by means of cookies, please disable the use of cookies in your web browser.

9.5          Cookies may, however, be necessary to provide you with certain features available on the Website.  If you disable cookies you may not be able to use these features, and your access to our Website will be limited.

11           Direct marketing

11.1        If you have ordered products from us, we may send you marketing communications and advertisements about our other products and services. If you have not ordered products from us but wish to receive our communications, please sign up for our newsletter from the link provided on the top menu of the website.

11.2        You may opt out of receiving communications from us at any time by unsubscribing from our mailing list using the unsubscribe option located below all email communications.

12           Limitation of liability and indemnity

12.1        To the extent permitted by law, we will not be liable for any loss, damage or other liability resulting from:

(1)           your use of the Website or those of third parties;

(2)           your inability to use the Website;

(3)           the unauthorised use or disclosure of your personal information by a third party where you have given us permission to share it with them; or

(4)           any termination of communications with you.

12.2        You indemnify and hold us harmless against any loss, damage or liability arising from your use of the Website your breach of these Terms or the violation of any law or rights of a third party.

13           Intellectual property

13.1        We and our licensors retain all rights in intellectual property on the Website and in our communications with you, including copyright, trademarks (both names and logos) and registered domain names.

13.2        You may not use, copy or distribute any of this intellectual property without our prior written permission.

14           Notices

Any notice published on the Website or sent to you directly at the email address you provide will be deemed received.

15           Disputes

15.1        In the event of a dispute between you and us, which cannot be resolved by our customer service team or the intervention of senior management, either of us may approach a court or tribunal of competent jurisdiction.

15.2        We do not currently subscribe to any alternative dispute resolution mechanism.

16           General

16.1        No indulgence by us or failure to strictly enforce these Terms is to be construed as a waiver or be capable of founding estoppel.

16.2        Any illegal or unenforceable provision of these Terms may be severed and the remaining provisions will continue in force.

16.3        These Terms are governed by South African law.
